The accused Bodenstein participated in the assault of an airman after he had surrendered. At the same day, three airmen bailed out of their disabled plane near Schweina. One of them was killed in landing and the other two were taken into custody and, after interrogation, were locked in cells at the local jail. One of them was shot dead by a guard, allegedly while trying to escape. The third flyer was ordered to assist in the burial of his comrades at the local cemetery. After attacking accused Bodenstein the flyer made an escape attempt and was shot dead in pursuit
