The accused participated in the killing of a member of the United States Army, after he bailed out of his disabled bomber in the vicinity of Frein, Austria. The airman was immediately captured and while being transported to higher ranking officials he was shot dead. After delivering the body of the first victim to Muerzsteg, the accused picked up another recently captured airman in the town of Taschl. After the interrogation of the airman, he too was shot and killed.
